I. GBITech exercises no control whatsoever over the content of the information passing through the Internet or our server(s). GBITech makes no warranties of any kind, whether expressed or implied, for the service it is providing. GBITech also disclaims any warranty of merchantability or fitness for a particular purpose. GBITech will not be responsible for any damage you or your organization may suffer. This includes loss of data resulting from delays, non deliveries, misdeliveries, or service interruptions caused by its own negligence or your errors or omissions. Use of any information obtained via GBITech’s Services is at your own risk, GBITech specifically denies any responsibility for the accuracy or quality of information obtained through its services.

II. GBITech’s Hosting/Web Service may only be used for lawful purposes. Transmission of any material in violation of any US or state regulation is prohibited. This includes, but is not limited to: copyrighted material, material legally judged to be threatening or obscene, or material protected by trade secret. You and your organization agree to indemnify and hold harmless GBITech from any claims resulting from your use of the service which damages you, your organization or another party.

III. Abuses of GBITech’s Hosting/Web Service will not be tolerated. Abuses include, but are not limited to: participation in chain letters, sending of mass unsolicited e-mail for commercial advertising purposes, providing a clearinghouse for software or other BBS-style services from an individual or corporate account, sending of unsolicited harassing or sexually explicit e-mail. Accounts participating in the above activities may be suspended or terminated without notice.

IV. Any access to other networks connected to GBITech must comply with the rules appropriate for that other network. Use of GBITech’s Hosting/Web Services may be for any lawful purpose. Use of GBITech’s Hosting/Web Service for lawful commercial purposes is both permitted and encouraged. Connectivity is provided for you and your organization only, resale or use of the connection by another individual is prohibited.

V. Payment is due 10 days after date of invoice. Accounts are in default if payment is not received within 10 days after date of invoice. If your payment is returned to GBITech unpaid you or your organization are immediately in default and subject to a returned check charge of $29.00 from GBITech. Accounts in default (unpaid 10 days after date of invoice) may have their service interrupted. Such interruption does not relieve you or your organization of the obligation to pay the monthly charge. Only a written request to terminate your service relieves you of your obligation to pay the monthly account charge. Accounts in default are subject an interest charge of 2.0% per month on the outstanding balance. In addition, re-activation of a locked account will be subject to a re-activation fee of $25.00 If you or your organization default, you agree to pay GBITech its reasonable expenses, including attorney and collection agency fees, incurred in enforcing its rights under these Terms and Conditions. Credit card fraud is a felony and GBITech will aggressively prosecute anyone attempting to misuse a credit card number. GBITech track every transaction and will use all means available to prosecute persons attempting fraud.

VI. Service is invoiced monthly. After the initial three-month commitment service may be canceled in writing at any time with acknowledged receipt from GBITech’s office, however, canceling a commitment greater than one month is subject to a cancellation penalty. Prices are for delivery FOB Shreveport, LA. GBITech reserves the right to change the rates by notifying you or your organization 30 days in advance of the effective date of the change.

VII. Software piracy committed through GBITech's server impact our staff and open GBITech to legal retribution by software companies. As you can see, this is a serious matter. GBITech will not tolerate acts of software piracy committed on or through any GBITech system. If you choose to transfer pirated software to and/or through our server, your access will immediately be restricted and your name turned over to the Software Publishers Association, an organization which prosecutes software piracy around the globe.

VIII. These Terms and Conditions supersede all previous representations, understandings or agreements and shall prevail notwithstanding any variance with terms and conditions of any order submitted. Use of GBITech’s Hosting/Web Services constitutes acceptance of the Terms and Conditions.
